Terms of Use

In this document, "the Company" refers to ŞAH BOYA MOBİLYA DEKORASYON SAN. VE TİC. LTD. ŞTİ., "the Website" refers to the website published at https://rolvens.com, and "the User" refers to any natural or legal person who visits or uses the Website in any manner.

By accessing and using the Website, the User is deemed to have accepted these Terms of Use. The terms apply to all pages of the Website, to the contact and quotation request forms, and to all content made available through the Website.

The Website is published in Turkish, English and Arabic. The Turkish version of this document is the original text; in the event of any inconsistency between the translations, the Turkish text prevails.

Explanations regarding the processing of personal data and the use of cookies are provided in the separate privacy notice and cookie policy published on the Website.

The Website has been prepared to present the Company's garden/outdoor and indoor furniture products and to enable visitors to request information and quotations about these products. The products may be inspected in person at our physical showroom in Kayseri.

No electronic sales are carried out through the Website. Accordingly:

The product images and videos on the Website are for presentation purposes. Natural materials such as wood, natural stone and fabric may show differences in texture, grain and colour; colours may also appear different depending on the screen, resolution and lighting conditions used. Such differences are not considered defects of the product. For the actual appearance, dimensions and material characteristics of a product, a showroom visit or direct contact with the Company is recommended.

The product range, descriptions and availability shown on the Website may change without prior notice, and certain products may become temporarily or permanently unavailable.

• The Website has no shopping cart.
• No payment is collected through the Website; there is no checkout page or payment infrastructure.
• Product prices are not published on the Website.
• There is no membership, account creation or user login.
• Ordering, shipping, delivery and return processes are not carried out through the Website.

The User may submit a request regarding products of interest through the contact form, the price/quotation request form or the WhatsApp link available on the Website. Such requests constitute a communication and information request only.

No content on the Website constitutes a binding price quotation, an offer in the legal sense, or a commitment to sell. Likewise, a quotation request submitted by the User does not in itself create an order, a reservation or a sales contract.

The product price, size and material options, availability and delivery times, and other conditions are finalised through a discussion at the showroom or through a quotation communicated to the User by the Company. The Company reserves the right to evaluate, decline or not respond to any request received.

The User is responsible for ensuring that the contact details provided in a quotation request are accurate and belong to them. The Company cannot be held liable where a request cannot be answered due to incorrect or incomplete contact details.

The intellectual and industrial property rights in the Rolvens Home Garden Concept brand, its logo and trade name, and in all product images, videos, texts, promotional content, page design, layout and software on the Website belong to the Company, or the Company holds the right to use such content.

This content may not be copied, reproduced, modified, published, distributed, adapted, used on another medium or website, or used for commercial purposes without the prior written consent of the Company. Linking to the Website for personal and non-commercial purposes falls outside this restriction.

In the event of unauthorised use, the Company reserves all civil and criminal remedies available under applicable legislation.

The rights in any third-party trademarks, logos and embedded content that may appear on the Website belong to their respective owners.

The User agrees to use the Website in accordance with applicable legislation, the rules of good faith and these Terms of Use.

In particular, the User undertakes to comply with the following:

Where the Company identifies, or reasonably suspects, a breach of these obligations, it reserves the right to apply rate limiting to form submissions, to disregard the relevant request and to technically restrict access to the Website.

• To provide accurate, up-to-date information belonging to them in the forms, and not to use another person's contact details without authorisation.
• Not to use the Website for unlawful, misleading or offensive purposes, or for purposes that infringe the rights of third parties.
• Not to attempt to circumvent the Website's security measures, to gain unauthorised access to its infrastructure, or to create excessive load that would disrupt the operation of the Website.
• Not to collect, copy or reproduce the Website's content by automated means (bots, crawlers, scraping, data mining, automated form submissions and similar).
• Not to send spam, malicious software, harmful links or unsolicited commercial messages through the forms.

The Company makes reasonable efforts to ensure that the information on the Website is accurate, current and complete. Nevertheless, the content may contain material errors, omissions or outdated information; product features, materials and models may change for production or supply reasons. The information on the Website therefore does not constitute a binding commitment.

The Company does not guarantee that the Website will be uninterrupted, error-free or accessible at all times. Access to the Website may be temporarily suspended or interrupted due to maintenance work, technical faults, issues originating from infrastructure or content delivery networks, internet connectivity problems or events of force majeure.

To the extent permitted by applicable legislation, the Company is not liable for indirect damages arising from the use of, or inability to use, the Website. This limitation does not exclude liability arising from the Company's wilful misconduct or gross negligence.

The Website may contain third-party links and embedded content (for example WhatsApp redirection links and promotional videos delivered through Cloudflare Stream). The providers of such content are subject to their own terms of use and privacy policies; the Company is not responsible for their content, availability or practices. The Website also contains external links directing you to our Instagram profile; once you click such a link, Instagram's own policies apply.

The Company reserves the right to update these Terms of Use unilaterally in line with changes to its services, technical infrastructure or applicable legislation.

Updated terms take effect at the moment they are published on the Website. The "Last updated" date shown at the top of this document indicates the current version. Continued use of the Website after a change means that the User accepts the updated terms.

The Company is further entitled to change the design, content and product range of the Website without prior notice, to remove certain pages, and to suspend the Website temporarily or permanently.

These Terms of Use are interpreted and applied in accordance with Turkish law. The Courts and Enforcement Offices of Kayseri have jurisdiction over any dispute arising from these terms.

In respect of sales concluded at the Company's showroom in Kayseri, consumer rights arising from Law No. 6502 on Consumer Protection and related legislation are reserved. Persons qualifying as consumers have the right to apply to consumer arbitration committees and consumer courts within the monetary thresholds set out in the legislation. As no sales are made through the Website, this document does not constitute a distance sales contract.

Under Law No. 6563 on the Regulation of Electronic Commerce, separate consent is required for sending commercial electronic messages. The Company does not currently send newsletters or commercial electronic messages through the Website; should such a practice be introduced in the future, consent will be obtained from the relevant individuals in accordance with the legislation.
